1. Introduction and Acceptance of Terms
Welcome to VybeDraft (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the VybeDraft website (vybedraft.com), the free VybeDraft WordPress plugin, and the premium VybeDraft Pro plugin (collectively, the “Service”). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.
2. Description of Service
VybeDraft is an AI-powered WooCommerce listing generator designed to automate product uploads, draft SEO descriptions, and create product variations. The Service operates via a WordPress plugin that connects your store to third-party AI models.
3. The "Bring Your Own Key" (BYOK) Architecture and Third-Party Providers
VybeDraft operates strictly on a BYOK model.
Third-Party APIs: To utilize the AI features of the Service, you must connect your own valid API key from supported third-party providers (specifically OpenRouter or GitHub).
Separate Costs: Your VybeDraft Pro subscription covers the software license and priority support. It does not cover the cost of AI generation. You are solely responsible for any fees, usage costs, or limits incurred through your OpenRouter or GitHub accounts.
Third-Party Terms: By routing requests through OpenRouter or GitHub to access models like Gemini or GPT, you agree to abide by the respective Terms of Service of those providers. VybeDraft is not responsible for any changes in their pricing, model availability, API downtime, or account suspensions.
4. License Grant and Software Usage
VybeDraft Free: The free version of the plugin is distributed under the GNU General Public License (GPL).
VybeDraft Pro: Upon purchasing an annual subscription, you are granted a non-exclusive, non-transferable license to use the premium features of the software on websites you own or manage.
License Key Restrictions: Sharing, reselling, or publicly distributing your VybeDraft Pro license key is strictly prohibited and will result in immediate termination of your subscription without a refund.
5. Subscriptions, Renewals, and Cancellations
Annual Billing: VybeDraft Pro is billed on a yearly subscription basis. By entering your payment information, you authorize us to charge your payment method annually for the renewal fee.
Cancellation: You may cancel your subscription at any time through your account dashboard. If you cancel, you will retain access to Pro features, updates, and support until the end of your current billing cycle.
Post-Cancellation Usage: If your subscription expires, any WooCommerce products or listings previously generated by VybeDraft will remain on your website. However, you will lose access to the plugin’s generation features, future software updates, and technical support.
6. Refund Policy
We offer a 3-day money-back guarantee for VybeDraft Pro. If the software does not work as described or is incompatible with your standard WooCommerce setup, you may request a full refund within 14 days of your initial purchase. Please note that refunds are not granted for failure to configure third-party API keys (OpenRouter/GitHub) or for issues originating from the third-party AI providers themselves.
7. User Responsibilities
As a user of the Service, you agree not to:
Use the Service to generate illegal, harmful, or copyright-infringing material.
Attempt to reverse-engineer, decompile, or hack the VybeDraft Pro software or our licensing servers.
Overload or misuse the plugin in a way that disrupts your own server performance or violates the terms of your hosting provider.
8. Limitation of Liability and Disclaimer of Warranties
“As Is” Software: The Service is provided “as is” and “as available.” We make no warranties, expressed or implied, that the software will be completely free of errors or perfectly compatible with every third-party WordPress theme or plugin.
AI Generation Output: VybeDraft is an interface for third-party AI models. We do not guarantee the accuracy, SEO performance, or appropriateness of the text, titles, or tags generated by the AI. You are strictly responsible for reviewing all generated product listings before publishing them to your live store.
Liability Limit: In no event shall VybeDraft, its founder, or its affiliates be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business interruptions arising from the use or inability to use the Service. Our total liability to you for any claim arising out of these Terms will not exceed the amount you paid for your current annual subscription.
9. Modifications to the Terms and Service
We reserve the right to modify these Terms, pricing, or features of the Service at any time. If we make material changes to these Terms, we will notify you via email or by posting a notice on vybedraft.com. Continued use of the Service after changes are published constitutes your acceptance of the revised Terms.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to, or use of, the Service shall be instituted in a state or federal court located in Nigeria.
